3. TRACKING TECHNOLOGY BACKGROUND

  • Cookies

A cookie is a small data file that is placed on your web browser, or your computer or device, when you access and/or use a Site(s), which stores text that can later be read back by our Web server or third parties to track your activities on the Sites and across other websites. Cookies are used to recognize your browser and may enable us to recognize you as the same user who was at our Site in the past and relate your use of our Site to other information about you, such as Site Usage Information or Personal Data collected through other means. Cookies may be “session” cookies (i.e., last only for one browser session) or “persistent” cookies (i.e., continue in your browser until they expire or are affirmatively deleted).

  • Local Shared Objects (e.g., Flash Cookies)

A local shared object is similar to a cookie, except it is stored on your computer or mobile device, instead of your browser, using a media player or other software installed on your computer or device. A local shared object can store more than just text. Like cookies, it is also used to recognize you as the same user who was at our Site(s) in the past, and relate your use of our Site(s) to other information about you, such as your website usage information or personal data collected through other means. It allow the Site(s) to access and use the information collected to enhance and facilitate certain Site experiences, processes and functionalities.

  • Web Beacons and other Tags

Web beacons (also known as “clear GIFs” or “pixel tags”) are typically tiny, one-pixel images that are embedded on a page of a website or in electronic communications, such as an email message. These technologies help to verify when a certain page (or area) of a website is viewed, when a message is opened and when links or other content are clicked or viewed.

4. TRACKING TECHNOLOGY USES

We use Tracking Technologies (and the Site Usage Information collected through them) for the following reasons:

  • Strictly Necessary (Essential)

We use Tracking Technologies in order to deliver the Site(s) and have them function in the manner expected and/or requested. For example, we may use cookies to remember your consent choices when you return to the Site(s), to determine where to route our Site traffic to effectively distribute the workload across numerous computers. We may also use them to remember your preferred language or the region in which you are located, etc.

  • Functional

We use Tracking Technologies on our Site(s) to provide enhanced or custom functionality and personalization. They may be set by us or by third-party providers whose services we have added to our pages. For example, we may place cookies that allow us or third party providers (i) to measure the time of your requests to our servers and our responses, (ii) to test availability or use of existing or new features, (iii) to provide enhanced, more personal features based on your preferences, such as remembering the contents of your shopping cart.

  • Performance & Analytics

We use Tracking Technologies to monitor and analyze how you use our Site(s) or services (such as marketing emails), to analyze and measure performance of our marketing or advertising efforts, or to provide enhanced personalization. For example, we may place cookies that allow us or third party providers (i) to test new features, (ii) to record statistics about site usage, (iv) to track your activities on our Site(s) and emails, (iv) to track when you have made a purchase after following a link to our Site(s) from another online location, so that we can compensate the other party for sending us your business, and so forth.

  • Advertising

We use Tracking Technologies to improve our marketing efforts or deliver advertisements to you on our Site(s), via email or SMS (where applicable), or elsewhere online. By using these technologies we hope to better tailor advertisements to your interests based on your interactions or activities on our Site(s), in-store, and third party sites or platforms.

We maintain relationships with several social media and technology companies, currently Meta (Facebook and Instagram), TikTok and Pinterest, depending on the region. These companies offer their own targeted advertising or interest-based advertising programs that can match people who have shown interest in Michael Kors through our Site(s), stores or other services with profiles on their platforms or online properties. See the “Managing Tracking Technologies” section below for more information on how to opt out of interest-based or targeted advertising programs.

5. DOES ANYBODY ELSE USE SITE USAGE INFORMATION OR PLACE TRACKING TECHNOLOGIES ON YOUR SERVICES?

Most of the Tracking Technologies described above and used on our Site(s) are set by us (“First Party Cookies”) or are used in connection with our Site(s) and set by third-party service providers at our direction or on our behalf ("Third Party Cookies"). We may use First Party or Third-Party Cookies with respect to each of the uses set forth above (and as permitted by the choices communicated to us by you via the cookie banner or Privacy Preference Center).
